Party Walls etc Act 1996
Wall boundaries of a house are controlled by Statute rather than Boundary Presumptions, including Party Wall Fences. Party Fence Walls are solidly built, i.e. not of wood or other perishable material. This may give rise to a garden wall being both a Party Fence Wall (the solid part) and an ordinary garden fence (the perishable structure). The Act only controls the Party Wall and Party Fence Wall. Boundary Presumptions will not apply to these, but the fence would likely be subject to Presumptions and/or Fencing Protocols.
